3.3 We may process your account data when you sign up for an account through our website (“account data“). The account data may include your name, address, telephone number and email address as well as your previous orders through our website. The source of the account data is provided by you when signing up for an account and when making a purchase. The account data may be processed for the purposes of operating our website, providing our services, ensuring the security of our website and services, maintaining back-ups of our databases and communicating with you. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

The enquiry data may be processed for the purposes of offering, marketing and selling relevant goods and/or services to you. 3.7 We may process information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters (“notification data“). We use Mailchimp to manage our subscribers to the newsletter and to design and send out monthly marketing material. The legal basis for this processing is consent; either provided verbally by you at point of sale or through sign-up to the newsletter through our website. Because of this you will not receive our monthly newsletter by default as part of a sales transaction but instead will only be subscribed if you give express verbal or written consent. Consent to receiving the newsletter may be withdrawn at any time by clicking the ‘unsubscribe’ link which is at the bottom of every newsletter or by contacting us via one of the methods described in Section 13.3 below.
3.8 We record footage collected by our CCTV system in our gallery which is operated in compliance with our insurer obligations and for the safety and security of both customers and staff (“CCTV data”). The legal basis for this is both a legal obligation to our insurers and legitimate interest in protecting our business from theft and damage.
3.8 We may process any of your personal data identified in this policy where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.
3.9 In addition to the specific purposes for which we may process your personal data set out in this Section 3, we may also process any of your personal data where such processing is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
3.10 Please do not supply any other person’s personal data to us, unless we prompt you to do so.
4. Providing your personal data to others
4.1 We may disclose transaction data to our suppliers or courier company insofar as reasonably necessary for fulfilling your order, for example supplying the delivery address where the artwork purchased by you is being posted directly to you from the supplier.
4.2 Financial transactions relating to our website and services are handled by our payment services providers, Lloyds Cardnet. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. 4.3 In addition to the specific disclosures of personal data set out in this Section 4, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
5. International transfers and processing of your personal data
5.1 In this Section 5, we provide information about the circumstances in which your personal data may be transferred to and/or processed in countries outside the European Economic Area (EEA).
5.2 Our online art inventory system is supplied by a UK based company called Artlogic Media Limited. As such your data is held securely by Artlogic acting as a data processor. Artlogic uses the latest cloud infrastructure to protect your data. It is atomised and encrypted across a sophisticated cloud system that is fully resilient. The data is encrypted in transit using 256 bit TLS v1.1 or v1.2. Because of the way Artlogic processes your data with multinational service providers your details may be processed outside the EU, however adequate operational and technological provision will be in place to ensure that the data is held securely. 6. Retaining and deleting personal data
6.1 This Section 6 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
6.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
6.3 We will retain your personal data as follows:
(a) usage Data will be retained for a maximum period of 26 months following creation;
(b) CCTV Data will be retained for up to 3 months.
6.4 In some cases it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:
(a) the period of retention of account data, enquiry data, customer relationship data, transaction data and notification data will be determined based on whether it is still relevant to pursuing the legitimate interests of running our business, notwithstanding your rights to erasure and/or to withdraw consent explained further in Section 8.
6.5 Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
